Techub News reports, according to Cointelegraph, leaders of the U.S. Senate Judiciary Committee are seeking to remove developer protection provisions from the Senate cryptocurrency market structure bill, arguing that these provisions would weaken legal actions against unlicensed money transmission businesses. Senate Judiciary Committee Chairman Charles Grassley and the committee's top Democrat, Richard Durbin, wrote to Senate Banking Committee Chairman Tim Scott and top Democrat Elizabeth Warren, stating that the current draft would "create significant enforcement gaps for decentralized digital asset platforms." "Such regulatory gaps could attract criminal organizations—such as cartels and other sophisticated criminal networks—to flock to decentralized platforms." They added: "Criminals already use methods to conceal illicit transactions. This bill would make prosecuting such activities significantly more difficult."
The bill draft released on January 12 includes parts of the Blockchain Regulatory Certainty Act (BRCA), which aims to clarify that cryptocurrency software development and network maintenance activities are not subject to federal or state money transmission regulations.
